To the fullest extent permitted by applicable law, Cric Studio Canada Inc. shall not be liable for any claim, loss, damage, cost, or expense arising from reasonable, inadvertent, or unintentional inaccuracies, omissions, or differences between product listings, images, descriptions, specifications, availability information, or pricing and the actual product supplied, provided that we comply with any remedy required by applicable law.

We reserve the right to correct, update, amend, or remove any product information, image, description, price, promotion, offer, shipping charge, transit time, or availability information at any time without prior notice, including after an order has been placed.

Orders, Pricing and Payment

All prices are listed in Canadian Dollars and are subject to change without notice. We reserve the right to refuse or cancel any orders placed for products listed at an incorrect price due to typographical error or any other reason. Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third party for any modification, price change, suspension, or discontinuance of the Service. We accept various forms of payment, and by placing an order, you authorize us to charge the full amount of your purchase to the payment method provided.

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

Inventory Availability and Order Acceptance

All orders placed through our website are subject to acceptance and availability. Placing an order does not guarantee that the product is available, reserved, or accepted by us. An order is only accepted once we confirm and process it.

Although we make reasonable efforts to keep inventory information accurate, items may occasionally appear as in stock on our website when they are unavailable. This may happen due to human error, system error, inventory syncing delays, third-party platform issues, supplier stock discrepancies, delayed updates, or other circumstances outside our reasonable control.

If an item you ordered is unavailable, incorrectly listed, or cannot be fulfilled, we will contact you using the contact information provided at checkout. Where possible, we may offer you a suitable alternative, substitution, exchange, store credit, or a full refund. If you do not accept an alternative, or if no suitable alternative is available, we will issue a refund for the unavailable item or order.

To the fullest extent permitted by applicable law, once we have offered a suitable alternative or issued a full refund so that you have not suffered any direct financial loss for the unavailable item, Cric Studio Canada Inc. shall not be responsible for any further claims, damages, inconvenience, lost opportunity, delay, consequential loss, or other compensation arising from the item being unavailable, incorrectly listed, or mistakenly shown as in stock.

We reserve the right to refuse, cancel, or modify any order for any reason, including but not limited to product unavailability, pricing errors, product description errors, suspected fraud, payment issues, shipping restrictions, or errors in inventory information.

Shipping, Processing and Delivery

We generally aim to process and ship orders within 3 to 5 business days after payment has been received and the order has been accepted. Business days do not include weekends, public holidays, or any days on which our store, warehouse, suppliers, or shipping carriers are closed.

Shipping and processing timelines are estimates only and are not guaranteed. On rare occasions, processing or shipping may take longer than 3 to 5 business days due to order volume, inventory verification, supplier delays, product availability, staffing limitations, weather conditions, technical issues, fraud prevention checks, courier delays, customs processing, or other circumstances outside our reasonable control.

We use third-party shipping carriers and delivery service providers to ship orders. Once an order has been picked up by, handed over to, or accepted by a third-party carrier, the package is no longer within our direct possession or control. We are not responsible for carrier-related delays, missed delivery attempts, incorrect scans, tracking delays, lost packages, damaged packages, customs delays, weather delays, service interruptions, or any other issue caused by or occurring while the package is in the possession or control of the carrier.

That said, if a shipping issue occurs, we will make reasonable efforts to assist you by communicating with the carrier, providing available tracking information, helping initiate a carrier investigation where applicable, and facilitating a practical resolution where reasonably possible. However, we do not guarantee any specific delivery date, investigation outcome, reimbursement, replacement, or compensation unless required by applicable law or expressly agreed by us in writing.

Delivery times displayed on our website, at checkout, in order confirmations, or by shipping carriers are estimates only. Cric Studio Canada Inc. shall not be liable for any loss, claim, cost, expense, inconvenience, missed event, missed match, tournament issue, lost opportunity, or consequential damage arising from shipping delays, carrier delays, or delivery issues.

Customers are responsible for providing a complete and accurate shipping address at checkout. We are not responsible for delays, failed deliveries, lost packages, or additional costs resulting from incorrect, incomplete, or outdated shipping information provided by the customer.

Returns and Refunds

Please refer to our Return and Refund Policy for details on how to return products and request refunds. Refunds will be processed to the original payment method, and the customer is responsible for return shipping costs unless the return is due to our error.

Limitation of Liability

To the fullest extent permitted by law, Cric Studio Canada Inc. and its directors, employees, affiliates, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from your use of our website, products, or services. 

Without limiting the above, Cric Studio Canada Inc. shall not be liable for any indirect, incidental, special, consequential, punitive, or non-financial damages arising from or related to product listing inaccuracies, incorrect images, incorrect descriptions, inventory errors, unavailable products, order cancellations, shipping delays, carrier delays, delivery issues, or delayed inventory syncing. Our maximum liability, where liability cannot be excluded by law, shall be limited to the amount paid by you for the specific product or order giving rise to the claim.

Nothing in these Terms is intended to limit or exclude any rights or remedies that cannot be limited or excluded under applicable law.

Indemnification

You agree to indemnify, defend, and hold harmless Cric Studio Canada Inc., its affiliates, and their respective officers, directors, employees, and agents from any and all claims, liabilities, damages, losses, or expenses arising out of or in connection with your use of the website, your violation of these Terms, or your violation of any third-party rights.

These Terms shall be governed by and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of law principles. We make no representation that the products or services available on this website are appropriate or available for use in locations outside of Canada. If you access our website from outside of Canada, you do so at your own risk and are responsible for compliance with local laws.
